Loudoun Board of Supervisors Appeals to Governor to Veto Proffer Bill

The Loudoun County Board of Supervisors is appealing to Virginia Governor Terry McAuliffe to veto a bill passed by the General Assembly that would limit a locality’s ability to negotiate and accept proffers. On Tuesday, the Board unanimously adopted a resolution (full text below) that opposes Senate Bill 549, Provisions applicable to certain conditional rezoning proffers (SB 549), which is headed to Governor McAuliffe for his signature. The resolution states, in part, that the bill would “negatively impact” development of property in Virginia and “is antagonistic to orderly, managed and planned growth of vibrant neighborhoods.” The Board’s resolution highlights that, if signed by the governor, the bill will adversely impact the rezoning process, which is a critical part of development, and also would cause “upward pressure on local tax rates to pay for public facilities that can no longer be proffered.”
